📍 Overview

What is Trademark Class 3 in India?

TM Class 3 (Trademark Class 3) covers non-medicated cosmetics and toilet preparations, soaps, perfumes, essential oils, cosmetics, hair lotions, dentifrices (toothpastes), and cleaning, polishing, scouring and abrasive preparations — under the NICE Classification 13th Edition used by IP India.

If your business manufactures, sells, imports or exports cosmetics, skincare, haircare, makeup, perfumes, soaps, detergents, cleaning products, toothpaste or personal hygiene preparations, you must register under Trademark Class 3 to get exclusive rights across India for 10 years.

India’s beauty and personal care market is valued at over ₹2 lakh Crore and is one of the fastest-growing globally. Leading Indian brands like HUL (Dove, Lux, Sunsilk), L’Oréal India, ITC (Fiama), Mamaearth, Himalaya, and Emami are all registered under TM Class 3.

NICE 13th Edition (effective Jan 1, 2026): Class 3 now explicitly includes microbiome-friendly personal care preparations, waterless beauty formulations, and refillable cosmetic concentrates. Medicated cosmetics making pharmaceutical claims continue to belong to Class 5, not Class 3.

🔗 Coordinated Classes

Coordinated Classes You May Also Need

Most beauty and FMCG businesses need multiple trademark classes for complete brand protection.

⚠️
Important: Filing only Class 3 may leave gaps. If you also sell medicated variants (Class 5), beauty tools (Class 21), operate salons (Class 44), or run retail/e-commerce (Class 35), those classes need separate filings at ₹4,500–₹9,000 each.

📝 Registration Guide

How to Register a Trademark Under Class 3 in India

Complete step-by-step process to register your beauty or cleaning brand under TM Class 3 with IP India.

1

Conduct a Trademark Search

Search IP India’s portal at tmrsearch.ipindia.gov.in to confirm no identical or similar mark exists under Class 3. The beauty and FMCG category is highly competitive — thousands of brand names are registered. Check exact names and phonetically similar variations.

⏰ Time: 30 minutes to 1 day
2

Identify Your Class 3 Goods

Confirm your products fall under Class 3 using NICE 13th Edition. Prepare a precise description (e.g. “non-medicated shampoos; face wash; lipstick; laundry detergents”). If you also sell medicated variants, list them under Class 5 in a separate application.

📋 Use exact NICE 13th Edition descriptions
3

Prepare Your Documents

Gather: applicant identity and address proof, logo in JPG minimum 300×300 pixels, Form TM-48 Power of Attorney if filing through an agent, and MSME/DPIIT certificate if claiming the fee concession of 50%.

📄 See Documents section below
4

File Form TM-A on IP India Portal

File online at ipindia.gov.in. Pay: ₹4,500 for individuals/MSMEs or ₹9,000 for companies per class. Receive your application number immediately. Use the ™ symbol from this date.

⚡ E-filing saves ₹500 vs physical filing
5

Examination by Trademark Office

A Trademark Examiner reviews your application within 3–6 months. Common objections for beauty brands: descriptiveness (e.g. using generic words like “Glow”, “Shine”), similarity to existing marks. Reply within 30 days if an Examination Report is issued.

⏰ 3–6 months processing time
6

Publication in Trademark Journal

After passing examination, your mark is published in the Trade Marks Journal. Third parties have 4 months to oppose. Beauty and FMCG marks often face opposition from large companies — be prepared with prior use evidence.

📰 4-month opposition window
7

Registration Certificate Issued

Your Trademark Registration Certificate is issued, valid for 10 years across all of India. You can now use the ® symbol. Certificate is downloadable from the IP India portal.
